Terms of Service

4.1 Subject Matter and Acceptance

Fluximage (hereinafter, "the Service") is an image optimisation SaaS platform accessible at fluximage.io, owned by Miquel Costa (VAT/ID: 46961041D, with registered address at c/ vilassar 14, baixos 2 08014 Barcelona, and contact email hello@fluximage.io.

Accessing, registering for and using the Service implies full and unreserved acceptance of these Terms and Conditions (hereinafter, "the Terms"). If you do not accept these Terms, you must refrain from using the Service.

These Terms must be read together with the Privacy Policy and Cookie Policy published at fluximage.io.

4.2 Description of the Service

Fluximage provides an online image optimisation service that includes the following features, subject to the limits of the contracted plan:

• Bulk image compression (up to 20 images per session, maximum 20 MB per image).
• Format conversion between JPG, PNG, WebP and AVIF.
• Automatic generation of SEO-optimised alt text using artificial intelligence (OpenAI GPT-4o mini).
• Automatic file renaming with descriptive, SEO-optimised filenames.
• Bulk watermarking.
• Download of results in ZIP format.
• WordPress plugin (in development): direct integration from the content management system.
• REST API access (available on the Agency plan, in development).

4.3 Plans and Pricing

Fluximage operates on a freemium model. The plans and prices applicable at the time of purchase are those published on the website:

*Unlimited: up to a maximum of 50,000 images/month (technical anti-abuse limit).

4.4 AI Credit Top-ups

Users with an active paid plan (Starter, Pro or Agency) may purchase additional AI credit packs (top-ups) that never expire:

4.5 Billing and Payments

Payments are processed through Stripe. By subscribing to a paid plan, the user authorises recurring charges to the payment method provided (monthly or annual, depending on the chosen plan). Subscriptions renew automatically at the end of each billing period.

Prices shown do not include VAT or equivalent tax applicable in the user's country. The applicable tax will be calculated at the time of purchase in accordance with the regulations in force in the user's country and the EU OSS scheme rules.

Fluximage reserves the right to modify prices, providing at least 30 days' prior notice by email. During this period, the user may cancel their subscription without penalty.

4.6 Cancellation Policy

• Subscriptions may be cancelled at any time from the user panel, without penalty or additional cost.
• Access to the contracted plan's services is maintained until the end of the current billing period.
• Once the paid period ends, the account automatically reverts to the Free plan (with its corresponding limitations).
• Unused monthly AI credits do not carry over to the following month.
• AI credits purchased as top-ups never expire and are retained in the event of cancellation and subsequent reactivation of the account.

4.7 Right of Withdrawal (EU Consumers)

Important notice for consumers: In accordance with EU Directive 2011/83/EU on consumer rights, transposed into Spanish law by Royal Legislative Decree 1/2007 (LGDCU), consumers (natural persons acting outside their professional capacity) have the right to withdraw from the contract within 14 calendar days of the subscription date, without providing any reason and without any penalty.

IMPORTANT EXCEPTION: When subscribing to a paid plan, the user will be asked to give their express consent to the immediate commencement of the Service. The user acknowledges that, once the Service has been fully performed (for example, once AI credits have been consumed or compressions carried out), they will lose the right of withdrawal. This waiver is recorded and confirmed at the time of purchase.

To exercise the right of withdrawal (where applicable), the user must send an email to hello@fluximage.io with the subject line "Right of Withdrawal" within 14 calendar days of the subscription date.

4.8 Refund Policy

• As a general rule, no refunds are issued for unused partial subscription periods.
• Within the first 14 days of purchase, if the right of withdrawal has not been expressly waived and the service has not been fully performed, the user may request a full refund.
• In the event of a technical error attributable to Fluximage that has significantly prevented the use of the Service, compensation in the form of additional credits or an extension of the subscription period will be assessed.
• AI credit top-up packs are non-refundable once purchased.

4.9 User Obligations

The user agrees to:

• Use the Service lawfully, in accordance with applicable law, these Terms, and public order and morality.
• Hold all necessary rights (intellectual property, image rights, etc.) over the images uploaded and processed through the Service.
• Not upload images that infringe third-party rights or that contain illegal, pornographic, violent or discriminatory content.
• Not attempt to breach the security of the Service, reverse-engineer the code, or exceed the established technical limits.
• Maintain the confidentiality of login credentials and immediately notify any unauthorised use to hello@fluximage.io.
• Not transfer the account or login credentials to third parties.

4.10 Responsibility for Content

The user is solely responsible for the images they upload and process through the Service. Fluximage acts as a mere technical service provider and does not monitor the content of uploaded images:

• Fluximage does not verify or warrant that the user holds the necessary rights over the images processed.
• Fluximage is not liable for any damages to third parties resulting from the user's unlawful use of the Service.
• The user agrees to hold Fluximage harmless from any third-party claims arising from the content of the images uploaded.

4.11 Intellectual Property

All source code, design, logos, the "Fluximage" trademark and all elements of the Service fluximage.io are the property of Miquel Costa and are protected by intellectual and industrial property law. Reproduction, distribution or exploitation without express written authorisation from the owner is strictly prohibited.

The alt text and filenames generated by artificial intelligence as a result of the Service become the property of the user who has contracted the service. Fluximage makes no claim over content generated for its users.

Fluximage makes no claim over the original images uploaded by users. The user is solely responsible for holding all necessary rights over the images they process.

4.12 Limitation of Liability

The Service is provided "as is" and "as available", without any express or implied warranties of any kind. In particular, Fluximage shall not be liable for:

• Loss of images once automatically deleted from servers (15 minutes after processing). The user is responsible for maintaining backup copies of their original images.
• Interruptions to the AI service caused by third parties (OpenAI) or by force majeure events, cyberattacks or third-party infrastructure failures.
• Compression results, alt text or filenames that do not meet the user's specific expectations or requirements.
• Indirect, incidental, special or consequential damages, including loss of profits or data, arising from the use of or inability to use the Service.

In no event shall Fluximage's total maximum liability to the user exceed the amount paid by the user during the 3 months preceding the event giving rise to the claim.

4.13 Modifications to the Service and Terms

Fluximage reserves the right to modify, suspend or discontinue the Service or any of its features. For substantial changes to these Terms or to pricing, users will be notified by email at least 30 days in advance. During this period, the user may cancel their subscription without penalty. Continued use of the Service following the publication of changes will constitute acceptance of the new conditions.

4.14 Suspension and Termination of Account for Breach

Fluximage reserves the right to suspend or terminate a user's access to the Service immediately and without entitlement to a refund in the event of:

• Breach of any of these Terms.
• Fraud or attempted fraud in payments.
• Abusive use of the Service that exceeds technical limits or damages the infrastructure or other users.
• Uploading images with illegal content or that infringe third-party rights.

4.15 Communications

Official communications between Fluximage and the user will be made by email. Users may contact Fluximage at hello@fluximage.io for any query, incident or exercise of rights.

4.16 Severability

If any clause of these Terms is declared null or unenforceable by a final court ruling, the remaining clauses shall remain fully in force.

4.17 Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with applicable Spanish law. For the resolution of any dispute, the parties submit to the jurisdiction of the Courts and Tribunals of Barcelona, expressly waiving any other jurisdiction.

Without prejudice to the foregoing, for users who qualify as consumers resident in the European Union, the mandatory consumer protection provisions of their country of residence shall apply to the extent they cannot be waived.
